This form has been developed in accordance with the requirements applicable to Quebec-licensed travel agencies, as well as sailing schools affiliated with Sail Canada and Voile Qu\u00e9bec.<\/p>\n\n

\n\n

1. Organizer Identification<\/strong><\/p>\n\n

SWEN Voile Inc. is a travel agency duly registered in Quebec (number: CCV202412353971-G). <\/p>\n\n

Payments received for trips and activities are protected in accordance with the Quebec Travel Agents Act.<\/p>\n\n

SWEN Voile Inc. is mandated to manage the cruising sailing school of the Beaconsfield Yacht Club<\/a>, which is affiliated with Sail Canada<\/a> and Voile Qu\u00e9bec<\/a>.” <\/p>\n\n

It is strongly recommended to obtain personal insurance covering nautical activities as well as cancellation insurance.<\/p>\n\n

2. Participation Requirements<\/strong><\/p>\n\n

2.1 Physical Fitness<\/strong><\/p>\n\n

I declare that I am in good physical condition and fit to participate.<\/p>\n\n

I confirm that I have no incompatible or undisclosed medical conditions.<\/p>\n\n

I agree to inform the organizer of any relevant condition.<\/p>\n\n

2.2 Participant Commitment<\/strong><\/p>\n\n

I agree to:<\/p>\n\n

  • Comply with all safety instructions<\/li>\n\n\n\n
  • Wear the required equipment (including the PFD)<\/li>\n\n\n\n
  • Maintain prudent and responsible behavior<\/li>\n\n\n\n
  • Immediately inform the instructor of any hazardous situation<\/li>\n<\/ul>\n\n

    3. Participant Liability<\/strong><\/p>\n\n

    I acknowledge that I am responsible for my actions at all times.<\/p>\n\n

    I agree to assume the costs for any damage caused to the vessels, equipment, or facilities resulting from my fault, negligence, recklessness, misuse of equipment, or failure to follow instructions, except in cases directly attributable to the fault of the organizer or its representatives.<\/p>\n\n

    4. Inherent Risks of the Activity<\/strong><\/p>\n\n

    I acknowledge having been informed of the risks associated with sailing, including:<\/p>\n\n

      \n
    • Falls, injuries, fractures<\/li>\n\n\n\n
    • Contact with equipment or objects<\/li>\n\n\n\n
    • Hypothermia or heat exposure<\/li>\n\n\n\n
    • Collision between vessels<\/li>\n\n\n\n
    • Risk of drowning<\/li>\n\n\n\n
    • Changing weather conditions<\/li>\n<\/ul>\n\n

      I am participating voluntarily and with full knowledge of the facts<\/p>\n\n

      \n\n

      Emergency Intervention<\/strong><\/p>\n\n

      I acknowledge that, in the event of an emergency or if my condition does not allow me to provide consent, the instructor or the organizer is authorized to take any measures deemed necessary to ensure my safety, including medical care and transportation, at my expense.<\/p>\n\n

      5. Release of Liability<\/strong><\/p>\n\n

      To the extent permitted by law:<\/p>\n\n

      I release SWEN Voile Inc.<\/strong>, its directors, instructors, employees, representatives, as well as the Beaconsfield Yacht Club, from any and all liability for any injury, loss, or damage that may occur in connection with my participation in the activities, including, but not limited to, those resulting from the inherent risks of sailing.<\/p>\n\n

      I expressly waive any and all recourse, claims, or lawsuits against them, except in cases of gross negligence or intentional misconduct.<\/p>\n\n

      I acknowledge that the activity may be modified, shortened, suspended, or cancelled at any time, including for reasons of safety, weather, or operational requirements, without any compensation being due.<\/p>\n\n

      \n\n

      6. Alcohol and Drug Consumption<\/strong><\/p>\n\n

      I agree to:<\/p>\n\n

      • Not participate while under the influence of drugs;<\/li>\n\n\n\n
      • Consume no alcohol before or during the activity;<\/li>\n<\/ul>\n\n

        I understand that any consumption or behavior deemed inappropriate may result in immediate exclusion, without refund or compensation.<\/p>\n\n

        \u2610 I accept<\/p>\n\n

        \n\n

        7. Conduct and Exclusion<\/strong><\/p>\n\n

        The participant agrees to maintain respectful and safe conduct at all times, in compliance with all instructions.<\/p>\n\n

        Any behavior deemed, at the sole discretion of SWEN Voile Inc<\/strong>., its representatives (including instructors, employees, contractors, volunteers, or any mandated person) or the Beaconsfield Yacht Club, to be inappropriate, dangerous, aggressive, or uncooperative may result in immediate exclusion.<\/p>\n\n

        SWEN Voile Inc. and the Beaconsfield Yacht Club reserve the right to terminate the participant\u2019s involvement at any time, without notice, notably for safety reasons or to ensure the proper conduct of the activity, without refund or compensation. <\/p>\n\n

        The excluded participant must leave the premises or the activity at their own expense and under their sole responsibility.<\/p>\n\n

        They waive any and all claims, recourse, or compensation arising from such a decision.<\/p>\n\n

        \n\n

        8. Use of media<\/strong><\/p>\n\n

        I authorize SWEN Voile Inc. and the Beaconsfield Yacht Club<\/strong> to capture and use photographs, videos, or any other digital media representing me, within the context of the activities.<\/p>\n\n

        I authorize their use, reproduction, and distribution, in whole or in part, for promotional, advertising, or educational purposes, on any medium (including websites, social media, and publications), without any financial compensation.<\/p>\n\n

        This authorization is granted without any limit as to time or territory.<\/p>\n\n

        9. Participant\u2019s Declaration<\/strong><\/p>\n\n

        I confirm that:<\/strong><\/p>\n\n

        • The information provided is accurate, complete, and up to date;<\/li>\n\n\n\n
        • I have not omitted any relevant information that could affect my participation;<\/li>\n\n\n\n
        • I have taken note of the risks associated with the activity and I accept them with full knowledge of the facts;<\/li>\n<\/ul>\n\n

          • I may terminate my participation at any time, under my own responsibility;<\/li>\n\n\n\n
          • The instructor or organizer may terminate my participation, at any time and without notice, for safety reasons or to ensure the proper conduct of the activity;<\/li>\n<\/ul>\n\n

            10. Participation of Minors<\/strong><\/p>\n\n

            For any minor participant:<\/p>\n\n

            • Under 16 years of age: the presence of a parent or legal guardian is mandatory.<\/li>\n\n\n\n
            • 16 to 17 years of age: written authorization from a parent or legal guardian is required.<\/li>\n<\/ul>\n\n

              The parent or legal guardian:<\/p>\n\n

              • declares to have read and understood this document;<\/li>\n\n\n\n
              • accepts all terms and conditions on their own behalf and on behalf of the minor;<\/li>\n\n\n\n
              • authorizes the administration of emergency care if necessary;<\/li>\n\n\n\n
              • authorizes any medical intervention deemed necessary, including medical transportation, at their own expense;<\/li>\n\n\n\n
              • acknowledges assuming responsibility for the minor for the entire duration of the activity;<\/li>\n<\/ul>\n\n

                The signature of the parent or legal guardian is mandatory.<\/p>\n\n

                11. Electronic Signature<\/strong><\/p>\n\n

                \u2610 I agree to use an electronic signature and I acknowledge that it has the same legal value as a handwritten signature.<\/p>\n\n

                I acknowledge that this electronic signature constitutes proof of my consent and my contractual commitment.<\/p>\n\n
