This form has been developed according to the criteria for travel agencies holding a Quebec permit and sailing schools affiliated with Sailing Canada and Voile Québec.
1. Travel Agency
SWEN Voile Inc. is a travel agency registered in Quebec (Registration Number: CCV202412353971-G).
Payments received are protected in accordance with the Quebec Travel Agents Act.
We recommend that every participant take out personal insurance for all water-based activities. Participation is at the sole responsibility of the participant.
2. Sailing School
SWEN Voile Inc. is mandated to manage the Beaconsfield Yacht Club Cruising Sailing School. The sailing school is affiliated with Sailing Canada and Voile Québec.
3. Liability
SWEN Voile Inc., the Beaconsfield Yacht Club, and its cruising sailing school (members of Voile Québec and Sailing Canada) decline all responsibility in the event of failure to follow instructions or the improper use of boats and/or equipment.
Any person signing this form assumes personal responsibility for their actions before, during, and after all activities.
Any damage caused to boats, equipment, personnel, or any other object related to the activities will be the responsibility of the signatory.
Note: Minors must obtain the written consent of a parent or legal guardian before participating.
You agree to:
- Comply at all times with the safety instructions provided by the instructor, a member of SWEN Voile Inc., or Beaconsfield Yacht Club staff.
- Wear the required safety equipment (specifically a life jacket/PFD)
- Maintain prudent and responsible behavior
- Inform the organizer and instructor of any relevant medical conditions

4. Inherent Risks of the Activity
I acknowledge that I have been informed of the risks associated with sailing and the activities offered by SWEN Voile Inc., the Beaconsfield Yacht Club, and its cruising sailing school. These risks include, but are not limited to:
- Injuries due to falls or sudden movements (sprains, strains, fractures, etc.)
- Injuries caused by blunt or sharp objects (branches, equipment, boom, etc.)
- Cold exposure or hypothermia
- Injuries related to accidental contact with other participants
- Collision between vessels
- Contact with water or risk of drowning
- Sunburn or heat-related disorders
I accept the intervention of a representative of SWEN Voile Inc., the Beaconsfield Yacht Club, and its cruising sailing school in the event of an emergency.
By accepting, you authorize any representative of SWEN Voile Inc., the Beaconsfield Yacht Club, and its cruising sailing school to provide all necessary first aid. You also authorize SWEN Voile Inc., the Beaconsfield Yacht Club, and its cruising sailing school to make the decision, in the event of an accident, to transport you or your child (by ambulance, helicopter, Coast Guard, or otherwise) to a hospital or community health facility, at your expense where applicable.*
By accepting, you are voluntarily participating in this activity organized by SWEN Voile Inc. within the framework of the Beaconsfield Yacht Club sailing school.
I confirm that I am in adequate physical condition to participate and have no known medical contraindications.

5. Property and Liability Waiver
I waive any claim regarding damage to my property or equipment (normal wear and tear, loss, breakage, theft, vandalism) during the activities of SWEN Voile Inc. through the Beaconsfield Yacht Club and its cruising sailing school.
To the extent permitted by law, I release SWEN Voile Inc., its instructors, employees, partners, and the Beaconsfield Yacht Club from any liability for injury, loss, or damage occurring during the activity, except in cases of gross negligence or intentional misconduct.
I acknowledge that the activity may be modified, shortened, or canceled due to weather conditions or for safety reasons, without any liability on the part of the organizer.

6. Alcohol and Drug Consumption
I agree not to participate in activities under the influence of drugs and to respect the legal blood alcohol limit (0.08 mg).

7. Integrity Policy in Sport
As a member school of Voile Québec and Sailing Canada, SWEN Voile Inc. (through the Beaconsfield Yacht Club and its cruising sailing school) applies the integrity policy established by Sport Canada to ensure a safe and respectful sporting environment.
I agree to comply with this policy and the Participant Code of Conduct by maintaining a sportsmanlike and respectful attitude toward everyone.

8. Use of media
I authorize SWEN Voile Inc., through the Beaconsfield Yacht Club and its cruising sailing school, to use photographs, videos, or any digital media depicting me in their publications, including on the Internet, for promotional purposes, without further approval or compensation.

9. I certify that the information provided in this form is accurate to the best of my knowledge. I certify that I have not deliberately omitted any health information, whether or not I deemed it relevant.
I am aware that the information contained in this form is confidential and is intended to better plan and manage the safety of the activities in which I will participate, and that it will allow SWEN Voile Inc., through the Beaconsfield Yacht Club and its cruising sailing school, to develop a client profile.
Having taken note of these risks and having had the opportunity to discuss them with a person responsible for the activity, I acknowledge that I have been informed of the inherent risks and I am able to undertake the activity or stay WITH FULL KNOWLEDGE OF THE FACTS AND BY ACCEPTING THE RISKS that this stay or activity may entail.
I also commit to playing an active role in managing these risks by adopting a preventative attitude toward myself and others around me.
The Captain, in their capacity as instructor, reserves the right to exclude without notice any person they deem to represent a risk to themselves or the rest of the group.
I understand that I may leave the current activity for one reason or another.

10. Consent for Electronic Signature
By checking here, you consent to the use of your electronic signature instead of an original paper signature. You have the right to request to sign a paper copy instead; by checking here, you waive that right. Following consent, you may, upon written request, obtain a paper copy of your electronic file. We will not charge you for this copy, and it will be viewable without special equipment or software. Your agreement to our use of your electronic signature for any document will remain valid until you notify us in writing of your wish to no longer use an electronic signature. There are no penalties attached to withdrawing your consent. Please ensure that the email address provided is valid so we may contact you regarding any changes.

11. Participation of Minors
By signing this form, the parent, legal guardian, or accompanying adult agrees to comply with all stated conditions and to ensure the minor’s safety.
Minors under the age of 16 may participate in SWEN Voile Inc. activities only if accompanied by a responsible adult. This adult must remain present and ensure the supervision of the minor for the entire duration of the activity. The parent or legal guardian must provide written consent for such participation.
Minors aged 16 to 17 may participate in activities with the written consent of a parent or legal guardian. A responsible adult must be present to supervise the minor for the entire duration of the activity.
Parents or court-appointed legal guardians must sign for any participating minor (under the age of 18) and agree that the minor is bound by all the terms and conditions of this document.
